Stuart Reynolds began his law practice at a large firm in New York City, where he gained extensive experience in antitrust, securities and financial institution law. A member of the state bar of Texas since 1984, Stuart has a broad range of experience in complex business litigation, and, based on his jury trial experience, is an Associate in the American Board of Trial Advocates. He teaches trial and deposition skills to law students and licensed attorneys as a member of the national faculty of the National Institute for Trial Advocacy. In addition to his active practice representing clients in the resolution of business disputes, Stuart engages in general corporate litigation advice and counseling, including advising clients on antitrust implications of proposed relationships or transactions. He also serves as a mediator by court appointment or selection by the parties.
Subject Matter Experience
- Represented a group of doctors, limited partners in a partnership run by an ambulatory hospital company, in disputing enforcement of covenant not to compete contained in limited partnership agreement, through trial and on appeal.
- Represented amateur sports association in a lawsuit and an arbitration (two related but different matters) challenging association’s rules and its decision concerning one of its member sports organizations.
- Represented partner in partnership dispute, through trial and on appeal.
- Represented multi-national company based in Ireland in dispute over contract with major U.S. distributor based in Texas, in hotly contested arbitration proceeding.
- Represented bank in dispute with another bank over a loan participation agreement.
- Represented borrower and guarantors in achieving forbearance and modification agreement with lender in connection with secured loan in default, which included getting lender’s collection lawsuit dismissed.
- Represented bank in connection with workouts or litigation with borrowers arising out of warehouse loan funding to mortgage broker that went into bankruptcy.
- Defended major life insurance company’s ERISA retirement plan in federal court, through court of appeals, where the key issue was whether claimant was “employee” for purposes of including certain earnings in benefit calculations.
- Represented bank in coverage action on Financial Institution Bond where coverage by insurer was denied.
- Represented a property management company in dispute over its trade name.
- Represented holder of various patents in litigation including complex discovery disputes over attorney-client privilege and work product issues.
- Defended major life insurance holding company in state court, including review by the state’s Supreme Court, where the key issue was whether shareholder’s derivative claim of questionable accounting practices had merit.
- Represented settlement of a major property/casualty insurance company as plaintiff in coverage case against its own CGL and E&O carriers, where the key issue was whether plaintiff’s multimillion-dollar liability to its insured on a homeowner policy claim was covered by insurer’s own policies.
- Represented both life and property/casualty insurance companies in first-party litigation, where the key issues involved conduct of companies in claims handling, coverage for particular losses alleged by insureds or wrongful termination claims by agents.
- Defended major retailer in several federal court cases alleging age discrimination, sexual harassment and other employment-related claims.
- Defended major sports trading card company in nationwide federal court class action, obtaining dismissal under Rule 12 (b)(6), affirmed on appeal, where the key issue was whether company’s business practices in sale of trading cards constituted gambling as a predicate act under federal RICO statute.
